By accessing this website and using our rental services, you agree to accept all terms and conditions written here. You must not use our services if you disagree with any of these standard terms and conditions.
2. Intellectual Property Rights
Other than the content you own, under these terms, WildWestOzRentals and/or its licensors own all the intellectual property rights and materials contained in this website and our services.
3. Restrictions
You are specifically restricted from the following:
– Publishing any website material in any other media without proper citation or permission;
– Selling, sublicensing, and/or otherwise commercializing any website material;
– Publicly performing and/or showing any website material;
– Using this website or our equipment in any way that is damaging, or in connection with any unlawful activity;
– Using this website to engage in any advertising or marketing without prior written consent.
4. Equipment Rental
– Booking: Customers must book equipment in advance through our website or direct contact. Full payment is required at the time of booking via our accepted payment methods.
– Use: Equipment must be used only for lawful purposes and in a manner consistent with the intended purpose. Instructions for safe and appropriate use will be provided and must be followed.
– Return: All items must be returned on time and in the same condition they were rented out. Late returns may incur additional charges.
– Damage: The renter is responsible for any damage to the equipment during the rental period, excluding normal wear and tear.
5. Cancellations and Refunds
Cancellations must be made at least 48 hours before the designated rental time to receive a full refund. Cancellations made less than 48 hours before the rental period are subject to a 50% cancellation fee. No refunds will be issued for cancellations made less than 24 hours before the rental period.
6. Disclaimer
The materials on WildWestOzRentals’ website are provided on an ‘as is’ basis. WildWestOzRentals makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
7. Limitation of Liability
In no event shall WildWestOzRentals, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this website or the equipment rented whether such liability is under contract. WildWestOzRentals, including its officers, directors, and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this website or services.
8. Indemnification
You hereby indemnify to the fullest extent WildWestOzRentals from and against any and/or all liabilities, costs, demands, causes of action, damages, and expenses arising in any way related to your breach of any of the provisions of these terms.
9. Severability
If any provision of these terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
10. Variation of Terms
WildWestOzRentals is permitted to revise these terms at any time as it sees fit, and by using this website, you are expected to review such terms on a regular basis to ensure you understand all terms and conditions governing the use of our services.
11. Governing Law & Jurisdiction
These terms will be governed by and interpreted in accordance with the laws of the State of Western Australia, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Western Australia for the resolution of any disputes.
